Terms of Service

These Terms of Service form a legally binding agreement between CypherTicks and the User. By accessing the website or purchasing an evaluation, you agree to these terms and the governing jurisdiction of England and Wales.

1. The Agreement

  • Binding Contract: These Terms constitute a legally binding agreement between CypherTicks (the Company) and the individual user (the User).
  • Acceptance: By accessing our website or purchasing a CypherOne evaluation, you agree to these Terms and our governing jurisdiction of England and Wales.
  • Eligibility: Users must be at least 18 years old and not reside in a prohibited or sanctioned jurisdiction.

2. Simulated Services Disclosure

  • 100% Simulated Environment: All services, including the CypherOne evaluation and CypherFunded (Sim) accounts, are provided in a simulated environment.
  • No Real Capital: No real funds are ever deposited by the User or allocated by the Company for live market execution.
  • Educational Purpose: Services are intended solely for personal, educational, and skill-assessment purposes.
  • No Financial Advice: CypherTicks is not a broker, investment advisor, or financial institution.

3. Virtual Credits & Performance Fees

  • No Cash Value: Account balances consist of virtual credits only and have no legal tender status.
  • Performance Fees: Payouts are discretionary and based on simulated success and compliance review.
  • Payout Ratio: Eligible Users may receive up to 90% of eligible simulated profits, subject to applicable consistency rules and minimum payout thresholds.
  • Tax Indemnity: The User is an independent contractor and is solely responsible for all tax liabilities in their home jurisdiction.

4. Prohibited Trading Practices

  • System Gaming: Strategies aimed at exploiting platform errors, price latency, or gaming the simulation are strictly prohibited.
  • Scalping Restrictions: Trades must meet the platform’s minimum duration and movement thresholds to be eligible for profit credit.
  • Account Termination: Violation of these rules may result in immediate account termination and forfeiture of any accrued Performance Fees.

5. Fees and Refunds

  • Evaluation Fees: Fees paid for the CypherOne evaluation are for the service of skill assessment and access to the platform.
  • No Refund Policy: Once evaluation credentials are issued and a first trade is placed, fees are generally non-refundable.

6. Data Protection & Privacy

  • UK GDPR: Personal data is handled in accordance with the Data Protection Act 2018 and UK GDPR.
  • Usage Data: The Company may analyze anonymized trading data for risk management and platform optimization.

7. Limitation of Liability

  • Service Interruptions: The Company is not liable for technical failures, platform outages, or data delays.
  • Total Liability: To the maximum extent permitted by law, the Company’s liability is limited to the amount of the last fee paid by the User.
